1. Acceptance of Terms
By installing, accessing, or using Colorful Radiology (the "Software"), you agree to these Terms of Service. You must accept these Terms before using the Software. If you do not agree, do not use the Software.
2. License Grant
Subject to these Terms, the software provider grants you a limited, proprietary, personal, non-transferable, non-exclusive, and revocable license to use the Software. You may not copy, redistribute, sublicense, sell, rent, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software except where applicable law expressly permits such activity. No rights are granted except those stated in these Terms.
3. Tester Program
Early-access TESTER licenses are provided for evaluation and may expire or be revoked at any time. Feedback is requested and may be used to improve the Software. Features, availability, and functionality may change or be removed without notice.
4. Not a Medical Device / Intended Use
Colorful Radiology is a documentation and text-template tool only. It supports radiology documentation workflow by transcribing dictated content and by extracting measurement values from ultrasound system data-sheet screenshots into draft, structured report templates for physician review and editing. It is intended for use by licensed physicians trained in diagnostic radiology and ultrasound interpretation.
The Software is not a medical device and does not diagnose, treat, recommend treatment, interpret diagnostic images, determine whether findings are normal or abnormal, or inform clinical decisions. It does not establish a physician-patient relationship between the software provider and any patient. The interpreting physician bears full responsibility for all clinical content and for the accuracy of the final report.
5. User Responsibility
You must independently verify extracted measurements and personally review, edit as necessary, and approve every report before submission or clinical use. All output is draft text. The Software makes no diagnoses or recommendations, is not medical advice, and is not a substitute for professional medical judgment. Each report and every consequence of its use remain solely the responsibility of the interpreting physician who signs the study.
6. Protected Health Information
The Software is not designed to receive, store, or process protected health information ("PHI"), and the software provider does not intentionally collect PHI. Do not enter patient names, medical record numbers (MRNs), dates of birth, accession numbers, or other patient identifiers in dictation, reports, or fields. The safest practice is to keep PHI out of the Software entirely. You are responsible for compliance with your institution's policies and all applicable privacy and data-protection laws.
7. Data Collection and Use
The Software stores usage and quality-improvement data locally on your computer. This local data may include report feedback and full report text, editor events and raw transcript content, dictation performance metrics, and logs showing that notices or disclaimers were acknowledged.
To support accuracy diagnostics, the Software also stores short raw audio WAV clips of low-confidence or otherwise suspect dictation utterances, together with transcript sidecars, locally on your computer. No more than 200 suspect clips are retained; the oldest are pruned when the limit is exceeded.
Voice-recognition accuracy metrics and usage statistics are shared with the developer only if you grant the separate, optional data-collection consent. That consent is revocable at any time in Settings. Granting it does not permit the intentional collection of PHI.
Optional features may transmit data when you explicitly enable or initiate them. Gmail communication transmits draft content to Gmail only when you initiate the feature; it creates a draft for your review, and the message is sent to its recipient only when you choose to send it. Cloud OCR transmits the material needed for OCR only when cloud OCR is enabled and used.
The software provider does not sell your data. Collected data is used to improve the product and for quality-improvement analysis.
8. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, the Software is provided "as is" and "as available," without warranties of any kind, express, implied, or statutory. The software provider disclaims all warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. No warranty is made that transcription, OCR, measurements, templates, or generated text will be accurate, complete, reliable, or error-free.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by [governing-law jurisdiction to be inserted], the software provider will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of data, revenue, or profits, arising from or related to the Software or these Terms, even if advised that such damages are possible. The software provider's total aggregate liability will not exceed the amount you paid for the Software during the [liability lookback period to be inserted]. These limitations apply to the fullest extent allowed by law in [governing-law jurisdiction to be inserted].
10. Termination
The software provider may suspend or terminate access to the Software, including revoking a TESTER license, at any time. You may terminate these Terms by stopping use of and uninstalling the Software. Upon termination, your license ends immediately. Sections concerning user responsibility, data, warranty disclaimers, limitation of liability, and any provisions that by their nature should survive will survive termination.
11. Changes to Terms
These Terms may be updated as the Software and its policies change. When the Terms version changes, you must review and accept the updated Terms before continuing to use the Software.
